Disciplinary Procedure

Disclosure

Providing information to both the court and to the other party

Discontinuance

Notice given by the Court, on instruction by the claimant, that they no longer wish to proceed with the case

Discovery of documents

Mutual exchange of evidence and all relevant information held by each party relating to the case

Discretionary Trust

This is a trust where the beneficiaries and/or their entitlements to the trust fund are not fixed, but are instead determined by the criteria set out in the trust instrument by the settlor

Discrimination

Less favourable treatment of one or more members of a specified group

Dismissal

To make order or decision that a claim be ceased

Dissolution

Distribution Agreement

This is an agreement which regulates the commercial terms whereby one party, the Supplier supplies goods and/or services to another party, the Distributor, for resale in a specified territory

District Judge

Judges whose duties involve hearing applications made within proceedings and final hearings

Dividend

The profit of trading divided among the members in proportion to their shares and in accordance with their rights as shareholders

Dock

Enclosure in the Criminal Court for the defendant on trial

Domicile

The country in which a person is normally resident

Dominant Land

The land which enjoys the benefit of the easement.

Due Dilligence

An investigation undertaken to assess the strengths and weaknesses of an intellectual property right

Duty of Care

A duty to take reasonable care not to cause physical, psychiatric or economic loss or harm
