The law in England and Wales defines domestic abuse as any incident or pattern of behaviour between individuals aged 16 or over who are personally connected, where the behaviour is abusive.

  • Coercive and controlling behaviour: manipulating, isolating, or restricting a person's freedom.

Legal protection against domestic abuse

There are several legal options available if you need protection from an abusive partner, ex-partner, or family member. Our domestic abuse solicitors can guide you through obtaining court orders to safeguard you and/or your children.

Non-molestation orders

A non-molestation order prevents someone from:

  • Using or threatening violence.
  • Harassing, intimidating, or pestering you.
  • Contacting you directly or indirectly.

Breach of a non-molestation order is a criminal offence, and the police can take immediate action.

Occupation orders

An occupation order determines who can live in the family home and can:

  • Require an abusive partner to leave the property.
  • Prevent them from returning or coming near the home.
  • Grant you the right to stay, even if the home is in their name.

If you have been locked out of your home, we can apply for an order to allow you back in.

Protection from harassment orders

If you are being stalked, harassed, or intimidated, we can help you apply for a harassment injunction under the Protection from Harassment Act 1997, although Non-molestation orders and occupation orders offer better protection if it is a family member who is being abusive.

How long do orders last?

This depends on the court but experience shows that they can last weeks, months, or for a year or more.

Can I get a court order if the abuse is emotional or financial?

Yes. Domestic abuse is not just physical — the law recognises emotional, psychological, and financial abuse.

  • Monitors your activities and isolates you from friends or family.
  • Threatens you to prevent you from leaving.

These are all forms of coercive control, and you may be eligible for legal protection.

How much does it cost to get legal protection?

Legal fees depend on the complexity of your case. However, some victims of domestic abuse may qualify for Legal Aid to cover court applications and legal representation. We do not offer Legal Aid, but can signpost you to local firms who do.
