Overview of the scheme

A client approached Birkett Long to assist in implementing a salary sacrifice scheme that would offer electric vehicles (EVs) to its employees. The scheme was designed for employees who opted in, allowing them to lease electric cars through a salary sacrifice arrangement. The vehicles would be provided by a third-party provider, with employees required to sign contractual agreements with both the provider and the client. These agreements introduced various obligations that had to be carefully reviewed to ensure they did not inadvertently create issues for the employer-employee relationship or cause any commercial detriment to the client.

Objectives of the scheme

The main goal for the client was to establish a clear and legally sound framework for the scheme. 

It was crucial to ensure that the legal obligations of employees opting into the scheme were fully understood and that the client, as the employer, met its responsibilities. Another significant concern was ensuring that the obligations created by the third-party electric vehicle provider did not interfere with the employer’s relationship with its employees.
